These Terms & Conditions apply when you use smithrespiratoryservices.com.au or deal with Smith Respiratory Services (SRS, we, us or our) about an oxygen concentrator, product enquiry, quote, purchase, rental, delivery, setup, demonstration or support. You or customer means the person using the website or acquiring the relevant goods or services.
Using this website means you accept the website-use parts of these terms. Submitting an enquiry does not oblige you to buy and does not require SRS to supply anything. A transaction begins only when SRS accepts an order or rental arrangement in writing, or accepts payment under an agreed quote or invoice.
A quote, invoice, manufacturer warranty or separate rental agreement can include additional terms for a particular transaction. Those specific terms apply to that transaction and prevail if they conflict with this page, except that no term excludes a right that cannot lawfully be excluded.
You must be at least 18 years old, or have the authority of the customer, to place an order or enter a rental arrangement. You must provide accurate contact, delivery and equipment-requirement information and tell SRS promptly if it changes.
ABOUT THESE TERMS
ORDERS, DELIVERY AND EQUIPMENT USE
PRODUCT INFORMATION
SRS aims to keep website descriptions, specifications, images and availability accurate. Product specifications, accessories and availability can change, and website images may be illustrative. Before accepting an order, SRS will confirm the model, important specifications, price and any included accessories in the quote, invoice or written order confirmation. If a material error is found before acceptance, SRS will correct it and give you the choice to proceed or withdraw.
CLINICAL RESPONSIBILITY
SRS supplies oxygen concentrators and provides product information, delivery, setup and demonstrations. SRS does not diagnose a condition, prescribe oxygen or replace a doctor, respiratory clinician or other qualified healthcare professional. Product information on this website is general and is not medical advice.
You are responsible for obtaining and following appropriate clinical advice and for ensuring that the selected equipment, flow type and settings match the user's current prescription. SRS can explain equipment features but does not guarantee a clinical outcome. If symptoms worsen, equipment appears not to deliver oxygen correctly, or an alarm cannot be resolved using the manufacturer instructions, follow the user's emergency plan and contact the treating clinician or emergency services.
Call 000 in an emergency.
QUOTES, ORDERS AND PAYMENT
A quote is valid for the period shown on it. Prices, GST, delivery, setup, accessories and any ongoing rental charges are included or excluded only as stated in the quote or invoice. Payment is due at the time and by the method stated in the accepted quote, invoice or rental agreement.
An order is subject to availability and SRS's written acceptance. If an ordered model becomes unavailable, SRS will contact you before supplying a substitute. A substitute will not be supplied without your agreement.
DELIVERY AND SETUP
Delivery dates and times are estimates unless SRS agrees otherwise in writing. SRS will take reasonable steps to meet an agreed delivery window and will contact you if a material delay becomes known.
You must provide a correct address, reasonable and safe access, and an authorised adult to receive the equipment. Tell SRS before delivery about stairs, restricted access or other circumstances that could affect safe delivery or setup. Any additional delivery or redelivery charge must be disclosed and agreed before it is incurred, unless the law permits otherwise.
For purchased equipment, ownership passes after full payment. Responsibility for reasonable care of the equipment passes on delivery, subject to the Australian Consumer Law and any written agreement.
RENTED EQUIPMENT
Rented equipment remains the property of SRS or the owner identified in the rental agreement. The customer must use, store and return it in accordance with that agreement and the manufacturer instructions. Rental period, charges, inclusions, return arrangements, loss, damage and fair wear are governed by the separate rental agreement. Any charge for loss or damage must be consistent with that agreement and applicable law.
SAFE EQUIPMENT USE
The user and customer must follow the current prescription, the manufacturer manual, SRS's demonstration and all safety warnings. Equipment must not be altered, opened, repaired by an unauthorised person, used with unapproved accessories or operated outside its intended purpose. Keep oxygen equipment away from smoking, flames, sparks, heat sources, oils and grease, and maintain ventilation and clearances required by the manufacturer.
The customer is responsible for normal daily checks, charging batteries where relevant, keeping vents clear and arranging a clinically appropriate backup plan for power failures, travel or equipment interruption. Contact SRS before moving a stationary unit, changing accessories or attempting anything not covered by the instructions.
CANCELLATIONS AND CHANGE OF MIND
Contact SRS as soon as possible if you wish to cancel or change an accepted order or rental. SRS will consider change-of-mind requests, but is not required to provide a refund or exchange for change of mind unless an agreed policy or applicable law says otherwise. Special-order goods may not be cancellable after SRS has committed the order to a supplier. Any cancellation or restocking cost must have been disclosed, agreed, reasonable and lawful.
Nothing in this section limits rights relating to faulty, unsafe, wrongly described or otherwise non-compliant goods or services.
CONSUMER RIGHTS, WEBSITE USE AND CONTACT
AUSTRALIAN CONSUMER LAW
Our goods and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, goods must be of acceptable quality, fit for a disclosed purpose and match their description. Services must be provided with due care and skill, be fit for a disclosed purpose and be supplied within a reasonable time where no time has been agreed. Most consumer guarantees also apply to hired or leased goods.
If a guarantee is not met, the remedy can include a repair, replacement, refund, cancellation or compensation, depending on whether the problem is major or minor and on the applicable law. Nothing in these terms excludes, restricts or modifies any consumer guarantee, warranty, right or remedy that cannot lawfully be excluded.
RETURNS, REPAIRS AND WARRANTIES
Contact SRS promptly if you believe equipment or a service has a fault or does not match what was agreed. SRS may ask for proof of purchase or rental and a reasonable opportunity to inspect or test the equipment before deciding the appropriate remedy. SRS is responsible for addressing rights against it under the Australian Consumer Law and will not require a consumer to deal only with the manufacturer.
A manufacturer's warranty is additional to, and does not replace, statutory consumer rights. Responsibility for collection, return transport and reasonable costs will be handled in accordance with the Australian Consumer Law and the circumstances of the equipment and fault. Damage caused by misuse, unauthorised modification, failure to follow instructions or ordinary wear is not a product fault, although this does not affect rights for an unrelated defect.
RESPONSIBILITY AND LIABILITY
Nothing in these terms excludes liability where exclusion is unlawful. To the extent the law permits, SRS is not responsible for loss caused by use contrary to a prescription, manual, safety warning or demonstration; inaccurate information supplied by the customer; unauthorised repairs or modifications; failure to maintain power, batteries or a suitable backup plan; or events outside SRS's reasonable control. This does not apply to the extent that SRS caused or contributed to the loss or applicable law provides otherwise.
WEBSITE USE AND INTELLECTUAL PROPERTY
You may use this website for lawful personal or business enquiries. You must not interfere with the website, attempt unauthorised access, introduce malicious code, scrape it in a way that disrupts its operation, impersonate another person or use its content for an unlawful or misleading purpose.
Website text, branding, graphics, photographs and layout are owned by or licensed to SRS unless stated otherwise. PRIVACY AND EXTERNAL LINKS
SRS handles personal information in accordance with the Privacy Policy published at smithrespiratoryservices.com.au/privacy-policy. External websites linked from this site are controlled by their operators. SRS is not responsible for their availability, content, products or privacy practices, and a link does not necessarily mean endorsement.
EVENTS OUTSIDE REASONABLE CONTROL
SRS is not in breach for a delay caused by events it could not reasonably control, such as severe weather, road closures, supplier interruption, transport disruption, power or telecommunications failure, natural disaster or government action. SRS will take reasonable steps to reduce the effect of the delay and communicate material changes. This clause does not remove any right available under applicable law.
CHANGES TO THESE TERMS
SRS may update the website-use terms when its services, systems or legal obligations change. The current version and last-updated date will appear on this page. Changes do not retrospectively alter an accepted quote, order or rental agreement unless the customer agrees or the law permits it.
GOVERNING LAW
These terms are governed by the laws of New South Wales and Australia. The parties submit to the courts and tribunals with jurisdiction in New South Wales, subject to any right a consumer has to bring a claim elsewhere.
